Introduction

Our Sole Traders name is Ardfert Furniture.

Goods means the goods to which this document relates.

Purchaser means the customer purchasing the said goods.

These conditions contain the contract between Ardfert Furniture in the case of any inconsistency these conditions shall prevail.

The risk of all goods shall pass to the purchaser upon collection  or delivery of the same in accordance with the terms hereof to the purchaser or its agents or other person to whom the purchaser has authorized delivery of the same and Ardfert Furniture shall have no responsibility in respect of the said goods thereafter and accordingly the purchaser should insure the same thereafter against such risks as it considers appropriate.

These conditions shall be interpreted exclusively and according to the law of the Republic of Ireland and the purchaser hereby accepts the jurisdiction of such Courts as Ardfert Furniture may nominate for the purpose or any action arising out of this contract.

All prices quoted by Ardfert Furniture are inclusive of Value Added Tax and the cost of delivery within our designated area.

Delivery will be arranged within our normal delivery areas on designated days.

Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled.

Ownership notwithstanding that the purchaser or its agents obtain possession of the goods all or any such goods will remain the property of Ardfert Furniture until Ardfert Furniture has received in cash or cleared funds payment in full for such goods and any other goods suppled to the purchaser by Ardfert Furniture under the contract to which the goods relate and Ardfert Furniture shall be entitled to all rights of access to the purchaser’s premises to enforce its rights hereunder. If the purchaser does not pay for the goods on the due date or dates for payment Ardfert Furniture may ( without prejudice to any of its other rights) sell or otherwise deal with or dispose of the said goods in  such manner as it may deem fit.

Where Ardfert Furniture has agreed to deliver the goods it shall not be liable for any loss of or damage to goods in transit unless written notice of such loss or damage is given by the purchaser to Ardfert Furniture within three working days of the date of delivery. The purchaser is advised to open and examine all goods upon receipt. Any liability which Ardfert Furniture may incur for non-delivery loss of or damage to goods shall in any event be limited to the invoice value of the goods not delivered lost or damaged and in no circumstances whatsoever shall Ardfert Furniture be liable for any indirect or consequential loss howsoever caused.

Ardfert Furniture will comply fully with all sale of Goods Acts enacted into Irish Law.
